Upon Remand from the Supreme Court.

WRIGHT, Presiding Judge.

Whereas on August 8, 1980, the Supreme Court of Alabama, 392 So.2d 1187, entered judgment upon writ of certiorari reversing the judgment of this court, 392 So.2d 1183, entered on October 31, 1979;

Upon remand, it is therefore considered by this court that the judgment of the Circuit Court of Calhoun County, Alabama, from which the appeal was originally taken to this court, is hereby affirmed.

AFFIRMED.

BRADLEY and HOLMES, JJ., concur.
