Opinion

Per Curiam.

The controlling issue in this case is identical with that in the companion case of Ryan v. Hirsch, Sheriff, [467]*467supra, and, on authority of that ease, the judgment of the Court of Appeals is reversed, and the cause is remanded to that court for further proceedings.

Taft, C. J., Zimmerman, Matthias, O’Neill, Griffith, Herbert and Gibson, JJ., concur.
