(No. 93-959 -- Submitted August 16, 1993 -- Decided October 13, 1993.) Appeal from the Court of Appeals for Cuyahoga County, No. 65070. Appellant, Theodore R. Jackson, Jr., sought a writ of mandamus in the court of appeals to compel appellee, Richard J. McMonagle, Judge of the Court of Common Pleas of Cuyahoga County, to hold a hearing on appellant's application for postconviction relief. The court of appeals dismissed the petition, holding that appellee had no duty to hold a hearing. This cause is before the court upon an appeal as of right.
