Relator’s out of time appeal has been granted,'and made'returnable to this court and the transcript of evidence and all pertinent parts of record for appeal have been placed in hands of counsel for relator. Any other remedy because of counsel’s failure to perfect appeal must be exhausted by other remedies _ before we can exercise our jurisdiction.
