For the reasons assigned in our opinion this day rendered in State of Louisiana, through the Department of Highways v. Barton, et ux., 231 So.2d 403, the judgment appealed in this case, State of Louisiana, through the Department of Highways v. Tate, is affirmed.

Affirmed.
