DENNIS, J., concurs in the denial solely for the purpose of allowing the petitioner to exhaust his state remedies and in recognition of the fact that a majority of this court is unwilling to modify its previous decisions as exemplified by this Court’s refusal to grant a rehearing in State v. Curtis, 363 So.2d 1375 (1978).
