It appearing to the court that the respondent herein has filed a return disclosing that said respondent has vacated its order of March 5, 1934, dismissing the application for rehearing and has ordered that the claim of relator be set down for the taking of testimony on *469 rehearing as provided in Section 1465-90, General Code, as prayed for in the petition herein; it is now ordered and adjudged by this court that this cause be, and the same hereby is, dismissed.

Cause dismissed.
