Opinion

Sentence, $250 fine and ten days imprisonment and costs of suit, and to stand committed until fine and costs are paid.

Davis and Shaltck, JJ., are of opinion that the term of imprisonment is too short in view of the gravity of the offense, and that in view of the doctrine of Hale v. State, 55 Ohio St., 210, the power of the court in that regard is not restricted by any valid statute.
