Opinion

KNOLL, Judge.

For the reasons stated in the companion case of State Department of Transportation & Development v. Estate of Payne, 586 So.2d 737 (La.App. 3rd Cir.1991), in which a separate decision is being rendered by us this day, the judgment of the trial court is reversed and remanded.

Costs of this appeal are assessed to all cross-claim defendants.

REVERSED AND REMANDED.
