All the questions arising in this case were settled in the case of The State Bank vs. Cason et al. (5 Eng. 479), and the previous cases of Ruddell & McGuire vs. Walker, (2 Eng. 457). McLarren et al. vs. Thurman, (3 Eng. 213). State Bank vs. Robert Bates, (5 Eng. 120.) The judgment must be affirmed.
