Opinion

MILLS, Judge.

Starke Nursing Home, Inc. appeals from a final order of the Division of Administrative Hearings dismissing a challenge to the validity of Florida Administrative Code Rule 10-2.36.

We affirm the hearing officer’s finding that appellant failed to demonstrate that the challenged rule is an invalid exercise of delegated legislative authority.

The other issues raised are not properly before this Court.

AFFIRMED.

NIMMONS, J., and PEARSON, TILLMAN (Ret.), Associate Judge, concur.
