16 To the Honorable JEREMY D. PETERSON, it is hereby stipulated by and between the 17 parties through their undersigned counsel, subject to the approval of the Court, that DEON 18 GOODGAIN be awarded attorney fees and expenses in the amount of $7583.22 under the Equal 19 Access to Justice Act (EAJA), 28 U.S.C. § 2412(d). This amount represents compensation for all 20 legal services rendered on behalf of Plaintiff by counsel in connection with this civil action, in 21 accordance with 28 U.S.C. §§ 1920; 2412(d). After the Court issues an order for EAJA fees to 22 DEON GOODGAIN, the government will consider the matter of assignment of EAJA fees to 23 PETER BRIXIE. The retainer agreement containing the assignment is attached as exhibit 1. 24 Pursuant to Astrue v. Ratliff, 130 S.Ct. 2521, 2529 (2010), the ability to honor the assignment 25 will depend on whether the fees are subject to any offset allowed under the United States 26 Department of the Treasury's Offset Program. After the order for EAJA fees is entered, the 27 government will determine whether they are subject to any offset. 28 1 Fees shall be made payable to DEON GOODGAIN, but if the Department of the Treasury 2 determines that DEON GOODGAIN does not owe a federal debt, then the government shall 3 cause the payment of fees, expenses and costs to be made directly to PETER BRIXIE pursuant t 4 the assignment executed by DEON GOODGAIN. Any payments made shall be delivered to 5 5 PETER BRIXIE. This stipulation constitutes a compromise settlement of DEON GOODGAIN

constitute an admission of liability on the part of Defendant under the EAJA or otherwise.
