ORDER DENYING MOTION FOR RECONSIDERATION (By: Ginoza, J., and Intermediate Court of Appeals Associate Judge McCullen, in place of Devens, C.J., recused, and Intermediate Court of Appeals Associate Judge Guidry, assigned by reason of vacancy; with McKenna, Acting C.J. and Eddins, J., dissenting)

Upon consideration of Defendant Sheila Medeiros’s

Motion for Reconsideration, filed September 9, 2026, which seeks

reconsideration of this court’s September 4, 2026 Findings of

Fact, Conclusions of Law, and Judgment, Defendant Medeiros has not established points of law or fact that this court has

overlooked or misapprehended. See Hawaiʻi Rules of Appellate

Procedure Rule 40(b) (eff. 2000).

Therefore, IT IS HEREBY ORDERED that the motion is

denied.

DISSENT BY McKENNA, ACTING C.J. AND EDDINS, J.

We would grant Sheila Medeiros’s Motion for

Reconsideration in part. For the reasons set out in our amended

separate opinion to be filed tomorrow, we would vacate Judgment

paragraph A of the September 4, 2026 Findings of Fact,

Conclusions of Law, and Judgment, and complete the primary after

the November 3, 2026 general election, with the winner deemed

elected under Article III, Section 4. We would deny the motion

in all other respects.
