concurs in the denial.

It would have been vain and useless for the trial court to remand this case to the agency for the appropriate hearing. The irregularity in plaintiff’s bid was fully explored in the trial of plaintiff’s case in the district court, which found that plaintiff’s bid was, indeed, “unbalanced” and subject to disqualification.
