IT IS ORDERED THAT: (1) The mandate of this court issued June 27, 2024, is recalled, the appeal is reinstated, and this court’s February 12, 2024, opinion and judgment are va- cated.

(2) The Final Judgment of the district court is affirmed. The case is remanded to the district court for fur- ther proceedings in accordance with the Supreme Court’s decision. The mandate shall issue 14 days from the date of this order.
