Appeal from an order of the Supreme Court (Harris, J.), entered January 14, 1997 in Albany County, which denied a motion by defendant Denny Nash, Inc. for summary judgment dismissing the complaint against it.

On December 5, 1987 at approximately 3:15 a.m., Charles Slater struck three pedestrians, including plaintiffs decedent, while driving his vehicle over the Green Island Bridge in the Village of Green Island, Albany County.
