The learned judge below followed the decision of Solinger v. Earle, impleaded, &c. (ante, p. 80), and his judgment must be [606]*606sustained. There has been at this term a motion for re-argument in Solinger v. Earle, which we have denied (ante, p. 604).

Judgment affirmed, with costs.
