This case comes before the court on defendant’s motion to dismiss plaintiff’s amended petition, and upon consideration thereof,

It is ordered this sixteenth day of January 1957, that defendant’s motion be and the same is granted and plaintiff’s petition, as amended, is dismissed on the grounds that this court lacks jurisdiction of the subject matter.
