Opinion
Appeal from an order dismissing the second cause of action in plaintiffs’ complaint. The allegations of the complaint, if established, entitled plaintiffs to relief against respondent and defendants Foote. The County Treasurer of Schoharie County is a proper defendant. Order reversed, on the law and facts, with $10 costs and disbursements. Motion to dismiss the second cause of action in the plaintiffs’ complaint denied, with $10 costs. All concur.
