Smith v. Winston
165 A.D. 938, 149 N.Y.S. 713
Appellate Division of the Supreme Court of the State of New York·Decided November 15, 1914·Published
Opinion
I dissent. Although the complaint devotes two printed pages to detailing the alleged negligence of the defendants, there is not a suggestion in it of the disregard of any of the matters which would bring the ease within the Employers’ Liability Act.
