There is no cogent reason why we should dispose of this case upon the merits on the appeal from the order. For aught that appears, the issues can be tried speedily. The merits can be considered upon an appeal from the judgment. Order affirmed, without costs. Jenks, P. J., Carr, Stapleton, Mills and Putnam, JJ., concurred.
