Opinion

Rose, J.

Appeal from an order of the Family Court of Broome County (Connerton, J.), entered May 27, 2004, which, inter alia, dismissed petitioner’s application, in two proceedings pursuant to Family Ct Act article 6, to modify a prior order of custody.

Petitioner and respondent are the parents of a son born in 2000. As the result of earlier proceedings, petitioner has sole legal and physical custody of the child while respondent is entitled to three hours of unsupervised visitation per week.
