Opinion
In a consolidated action for an injunction, to recover damages for breach of contract, and for other relief, the defendant Gentile appeals from so much of an order of the Supreme Count, Rockland County, entered December 30, 1959, as granted an injunction pendente lite. Appeal dismissed, without costs. The action having been settled by the parties, the appeal has become academic. Beldoek, Acting P. J., Ughetta, Christ, Pette and Brennan, JJ., concur.
