It is ordered and adjudged by this court, that the judgment of the said court of appeals be and the same is hereby affirmed.
Four members of this court concur in this judgment, but all members concurring have not agreed upon the reasons therefor. It is therefore proper for such individual judges as concur in said judgment. to file separate opinions setting forth their ■reasons for their action.
