Order, Supreme Court, New York County, entered on July 11, 1978, unanimously affirmed. Respondents shall recover of appellant $75 costs and disbursements of this appeal. The appeal from the order of said court entered on September 21, 1978, is dismissed as academic without costs and without disbursements. No opinion. Concur&emdash;Kupferman, J. P., Sandler, Lane, Markewich and Lupiano, JJ.
