—Proceeding pursuant to CPLR article 78, inter alia, to prohibit the respondents from prosecuting the petitioner for certain alleged violations of the Penal Law. Proceeding dismissed as academic, without costs or disbursements. On August 2, 1978 petitioner pleaded guilty to possession of gambling records in the first degree and a fine of $5,000 was imposed. Mollen, P. J., Martuscello, Latham and Shapiro, JJ., concur.
