Opinion
For a claim to succeed, it is necessary that there be negligence on the part of an officer, employee, involuntary servant or agent of the State while acting within the scope of his office, employment, service, agency or authority. N.C. Gen. Stat. §
In the instant case, Plaintiff has failed to allege a negligent act or omission on the part of any individual, much less an employee or agent of Defendant, as required by N.C. Gen. Stat. §§
For the foregoing reasons, Plaintiff's claim is hereby DISMISSED WITH PREJUDICE. The parties shall bear their own costs.
