Order granting defendant’s motion to vacate and set aside the notice of his examination before trial as an adverse party modified by permitting the examination of defendant as to items 3, 4, 7, 11 and 13, and as so modified affirmed, without costs; examination to proceed on five days’ notice. No opinion. Lazansky, P. J., Kapper, Hagarty, Tompkins and Davis, JJ., concur.
