Opinion

In an action to declare an assignment of a bond and mortgage void, and for incidental relief, the defendant appeals from an order of the Supreme Court, Kings County, dated August 24, 1960, denying his motion for summary judgment. Order affirmed, with $10 costs and disbursements. The record presents issues of fact which must he resolved by trial. Beldock, Acting P. J., Ughetta, Kleinfeld, Christ and Pette, JJ., concur.
