Order unanimously modified by striking from the last paragraph thereof the direction for entry of judgment, and as so modified affirmed, with twenty dollars costs and disbursements to the respondents, with leave to the plaintiff to serve an amended complaint within ten days after service of order on payment of said costs. No opinion. Present — Martin, P. J., Untermyer, Dore, Cohn and Callahan, JJ.
