However, on December 1, 2022, defendants informed the court plaintiff refuses to 21 | sign the settlement agreement. ECF No. 36 (sealed). Thus, plaintiff is ordered to show cause 22 | within fourteen days why this action should not be dismissed for lack of prosecution under 23 | Federal Rule of Civil Procedure 41(b). See Hernandez v. City of El Monte, 138 F.3d 393, 399 24 | (9th Cir. 1998) (citing Henderson v.
