Opinion

—Judgment and order unanimously affirmed as to defendant Fried, with costs; as to defendant Silverstone, in view of the [911]*911special finding of the jury, which we think is against the weight of the evidence, the judgment and order are reversed, and new trial granted, costs to abide the event. Present—Jenks, P. J., Burr, Carr, Rich and Stapleton, JJ.
