Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent, which, among other things, expelled petitioner from membership in the Selkirk Fire Department.

Petitioner has been a member of the Selkirk Fire Department, located in the Town of Bethlehem, Albany County, since 2001 and became the treasurer of Company No. 1 in January 2011. In June 2011, respondent issued a notice of charges against petitioner alleging that he had engaged in misconduct, including violations of the Fire Department’s bylaws and code of conduct.
