Opinion
{¶ 2} Attached to the motion to dismiss is a copy of a journal entry which indicates that on November 5, 2008, Judge McMonagle denied Sevayega's petition for post-conviction relief thereby rendering the petition for a writ of procedendo moot. State ex rel. Grant v.Coleman (1983),
{¶ 3} Accordingly, we dismiss Sevayega's petition for a writ of procedendo.1 Respondent to bear costs. It is further ordered that the clerk shall serve upon all parties notice of this judgment and date of entry pursuant to Civ. R. 58(B).
