Appeal from an order of the Supreme Court at Special Term, entered June 6, 1976 in Warren County, which granted defendants’ motion to dismiss the action for failure to serve a complaint and denied plaintiff’s cross motion to excuse her default and compel defendants to accept the complaint. Order affirmed, without costs, on the opinion of Gibson, J., at Special Term. Koreman, P. J., Greenblott, Kane, Mahoney and Larkin, JJ., concur. [89 Misc 2d 519.]
