Order of the County Court of Nassau county, granting plaintiff judgment “ as prayed for in the complaint,” reversed upon the law and the facts, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, upon the ground that the pleadings present an issue of fact for trial. Lazansky, P. J., Rich, Kapper, Hagarty and Scudder, JJ., concur.
