Opinion

OPINION OF THE COURT

Judgment appealed from and order of the Appellate Division brought up for review affirmed, with costs, for reasons stated in the opinion by Justice Arnold L. Fein at the Appellate Division (94 AD2d 29). The weight of the evidence more nearly comports with the findings made by the Appellate Division.

Concur: Chief Judge Wachtler and Judges Meyer, Simons, Kaye, Titone and Hancock, Jr. Taking no part: Judge Alexander.
