Judgment dismissing the complaint on the merits after trial without a jury affirmed, with costs. No opinion. Lazansky, P. J., Hagarty and Johnston, JJ., concur; Seudder and Tompkins, JJ., dissent and vote for reversal and the direction of judgment in favor of plaintiff.
