Action by beneficiary named in a policy of accident insurance to recover thereunder for the death of the insured in an airplane crash. Order granting plaintiff’s motion for summary judgment under rule 113 of the Rules of Civil Practice and denying defendant’s cross motion for similar relief, and the judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements.
