AFTER REMAND FROM THE SUPREME COURT

McMILLAN, Judge.

The judgment of the circuit court is reversed and this case is remanded on the [552]*552authority of Ex parte Sapp, 497 So.2d 550 (Ala.1986).

REVERSED AND REMANDED.
