Order unanimously reversed, with $20 costs and disbursements to the appellant, and the petition dismissed. In view of petitioner’s record, the action of the police commissioner in refusing to appoint petitioner permanently as a patrolman at the end of petitioner’s probationary service was not arbitrary, unreasonable or capricious. Concur — Botein, J. P., Rabin, Frank, Valente and Bergan, JJ.
