MEMORANDUM OF DECISION
The petitioner, in this habeas corpus action, is seeking a new trial. In the case of State v. Cummings, 67 Conn. App. 734 (January 29, 2002), in which the petitioner is also a defendant, the Appellate Court granted him a new trial.

Accordingly, the petition for habeas corpus has become moot, and this Court, sua sponte hereby dismisses this habeas petition.
