I. Did the court of appeals err by concluding that Sanders failed to preserve error regarding the trial court’s denial of two motions for mistrial because Sanders did not first seek an instruction to disregard, in apparent contravention of this Court’s opinion in Young v. State, 137 S.W.3d 65, 70 (Tex. Crim. App. 2004)?

II. Did the court of appeals err by holding that Sanders’ purported consent to the search of his cellular telephone was sufficiently attenuated from the taint of its illegal seizure by police to constitute voluntary and knowing consent sufficient to justify the warrantless seizure?

III. Did the court of appeals err by concluding that the evidence was legally sufficient to support the jury’s verdict of guilty of felony murder where there was insufficient evidence to support a conclusion that Sanders knew that Officer Sprague was attempting to arrest or detain him, in apparent contravention of the opinions of other courts of appeals, Redwine v. State, 305 S.W.3d 360, 362 (Tex. App. – Houston [14th Dist.] 2010, pet. ref’d), and Griego v. State, 345 S.W.3d 742, 752 (Tex. App. – Amarillo 2011), and of this Court, Jackson v. I. The court of appeals erred by concluding that Sanders failed to preserve error regarding the trial court’s denial of two motions for mistrial because Sanders did not first seek an instruction to disregard.

Petitioner requests oral argument and submits that oral argument would be

particularly helpful where, as here, the case involves questions of exceptional

importance. The holdings of the court below contravene opinions of this Court as

well as opinions of other courts of appeals, thus justifying discretionary review by

this Court under Rule 66.3 of the Texas Rules of Appellate Procedure. Oral argument

would therefore aid the Court in securing and maintaining uniformity of Texas court
