DECISION ON JOINT STIPULATION1
On June 6, 2019, Leonel Sanchez filed a petition for compensation under the National Vaccine Injury Compensation Program, 42 U.S.C. §300aa-10, et seq.2 (the “Vaccine Act”). Petitioner alleges that he suffered left shoulder injuries related to vaccine administration (”SIRVA”) resulting from the influenza vaccine he received on December 5, 2017. Petition at 1, ¶¶ 2, 16; Stipulation, filed at November 12, 2020, ¶¶ 1-2, 4. Petitioner further alleges he received the vaccine in the United States, that he suffered the residual effects of his SIRVA for more than six months, and that neither he nor any other party has filed a civil action or has received compensation for his SIRVA, alleged as vaccine caused. Petition at ¶¶ 2, 14-16; Stipulation at ¶¶ 3-5. “Respondent denies that [P]etitioner sustained a SIRVA Table injury and denies that [P]etitioner’s alleged shoulder injury was caused-in-fact by the flu vaccine.” Stipulation at ¶ 6.
