Chapter 62 of the Texas Code of Criminal Procedure assigns Defendants authority to require Plaintiff to register as a "sex offender" under Texas law ifhe would be required to do so under federal law. A U.S District Court ruled Plaintiff is not required to register under federal law, and declared Defendants' contrary determination ultra vires. However, on appeal the U.S. Court of Appeals (5th Cir.) ruled the Defendants in their official capacities were entitled to federal sovereign immunity, so the U. S. District Court was without jurisdiction. The Fifth Circuit expressly did not reach the "merits" of Plaintiff's federal claims. Pursuant to Section 16.064 (a) of the Texas Civil Practice and Remedies Code, Plaintiff then timely filed his original petition against Defendants in the Travis County District Court, alleging, under Texas law, an ultra vires act cause of action against Defendants based on a common core of facts. Without reaching the question of Defendants' claims to sovereign or official immunity under Texas law, the Travis County District Court dismissed Plaintiffs state law claims on the grounds that his claims were "barred by the doctrines of res judicata and collateral estoppel, and also lack any cognizable cause of action under Texas law." Res judicata and collateral estoppel require a prior decision "on the merits," which the Fifth Circuit did not reach; and Plaintiffvalidlv alleged an ultra vires act cause of action against Defendants in their official capacities under Texas law.
