_A.Ssoon as the order for judgment was set aside in tbit ease, the defendant’s counsel moved for leave to enter up judgment of non pros, which was refused,

A motion was submitted to reverse that order.— ’ But (here was nothing to support a judgment. The defendant had entered no appearance, neither had he filed n plea. This motion must also be dismissed.

Justices Nott, Johnson, Ganll, Richardson and ColcocIr, concurred. ' -
