Exceptions overruled. This is a petition to establish exceptions in an action of contract. The matter was referred to a commissioner who filed a report The single justice entered an order dismissing the petition, subject to the petitioner’s exception. From- an examination of the record, including the report of the commissioner, we are satisfied that there has been no error.
