AFFIRMED. See Roy v. Barnett Bank of Palm Beach County, 455 So.2d 496 (Fla. 4th DCA 1984). Our affirmance is without prejudice to Rudnick to seek relief from [1046]*1046the trial court pursuant to his previously-filed Motion for Relief from Judgment.
AFFIRMED; REMANDED for Consideration of Rudnick’s Motion for Relief from Judgment.
