The denial of appellant’s petition for writ of prohibition is affirmed on the merits. See Ashe v. Swenson, 397 U.S. 436, 90 S.Ct. 1189, 25 L.Ed.2d 469 (1970); Gragg v. State, 429 So.2d 1204 (Fla.1983).

Affirmed.
