Opinion
Order, so far as appealed from, unanimously modified by disallowing any discovery and inspection of defendant’s books and papers but to permit their use as provided in section 296 of the Civil Practice Act, and as so modified affirmed, with $20 costs and disbursements to the appellant. The date for the examination to proceed to be fixed in the order. No opinion. Settle order on notice. Present — Martin, P. J., Townley, Glennon, Dore and Cohn, JJ.
